NED NWOKO Vs NWAOBOSHI: Supreme Court Bemoans Delay Tactics, Adjourns Further Hearing To July 16

The Supreme Court has adjourned further hearing on the appeal filed by Prince Ned Nwoko challenging the ruling of the Court of Appeal over the Delta North Senatorial seat to July 16, 2019.

The date was fixed by the apex court after a failed attempt by Counsel to the First Respondent (Peter Nwaoboshi) Anthony Idigbe, to secure a longer adjournment having suggested July 22, 19 and 18 as preferred dates.

He had cited health challenges which required urgent medical attention abroad, but his proposed dates were rejected by the Apex Court judges who opted for a shorter adjournment, stressing that desperate situations called for desperate measures and describing the move by the Counsel as delay tactics.

Only one prayer was granted among Nwaoboshi’s cross appeal which was that the Supreme Court should rely on the information from the Court of Appeal records as a working tool by the panel.

One of the highpoints of today’s hearing was a failed attempt by Honourable Doris Uboh to gate crash.

His counsel, Barrister Obinna Nwosu, attempted to reintroduce her motion which was struck out at the last hearing of the case on July 2.

Uboh had withdrawn her appeal to be part of the case at the court’s last sitting following which it was struck out, but she attempted to smuggle in the motion again at today’s hearing.

Spirited efforts by her counsel to push through the motion proved abortive as it was struck out due to incompetence and lack of technical background.

The motion, by which Udoh sought to be joined in the suit as an interested party, floundered as the panel struck it out for the second time.

Furthermore, the second respondent (counsel to PDP) prayed the court to grant separate panels to handle each respondent’s case, but the judges unanimously kicked out what they considered a deliberate attempt to frustrate the cause of justice, saying both appeals came from one judgement and would be handled together.
