All Progressives Congress (APC), governorship candidate in Delta State, Chief Great Ogboru and his political associate, Senator Ovie Omo Agege, are in a fix over a litigation which may soon lead to their names being delisted from 2019 INEC ballot papers.
The legal battle is between APC National and Delta APC Exco led by Chief Cyril Ogodo.
The Ogodo faction is led by 2015 APC Governorship candidate, Olorogun Otega Emerhor, while the other faction is led by Chief Great Ogboru, who joined the party barely two years ago under strange circumstances, having declared Muhammadu Buhari, as an unfit and clueless person to be President of Nigeria, at a campaign rally in 2015.
The legal lacuna bothers on the illegality of Jones Erue’s state exco in a situation where the Ogodo faction was recognised and voted during the last APC National Convention held in Abuja.
In a radical twist, Adams Oshiomole, without regard to the party’s constitution, rule of law, equity and good conscience, recognised the Jones Erue’s faction.
The first round of the legal matter ended with an order restraining the submission of Delta APC Governorship and Delta Central Senatorial candidates names to the National Independent Electoral Commission (INEC), because the defendants did not comply with a consent judgment of court of competent jurisdiction; wherein harmonised delegates list was adopted for party primaries in Delta.
By consent judgment, it is meant that parties to an issue agreed without duress, to settle their differences and file same which the court rely upon to pass its final verdict.
It follows that in an attempt to display alleged leadership supremacy without due consideration to the rule of law, particularly the violation of a consent judgment, the Court of Appeal quashed the appeal of a judgment restraining APC from submitting the names of its governorship and Delta Central Senatorial candidates to INEC.
It is now crystal clear from the latest decision of the court above that Ogboru and Omo Agege, remain APC aspirants in the forthcoming general elections.
It is clear that it is OKOWA vs OKOWA, OBORO vs OBORO.
